§ 1-8. Table of penalties for penal violations of Code.

(a)

As per section 1-6(g), the table in this section is a listing of (i) Code provisions for which a violation may result in a violation of the State criminal penal laws which may be enforced by agents authorized by law to do so and (ii) the nature of the violation as either a misdemeanor or infraction as provided in G.S. 14-4. As of March 14, 2012, the maximum monetary fine or penalty for a misdemeanor under G.S. 14-4(a) is $500.00. Should there be no provision in this Code for the amount of penalty, the penalty is the maximum allowable by G.S. 14-4(a), which is currently $50.00. For a parking-related infraction, the maximum penalty is that provided under G.S. 14-4(b), which is currently is $50.00.

(b)

Unless otherwise specified in the applicable Code section, each day of any violation is a separate and independent violation for which an additional criminal penalty in the amount indicated in the applicable column is imposed.

(c)

The prosecution of penal fines, penalties or other sanctions under G.S. 14-4 does not preclude or affect the town's exercise of any one or combination of civil remedies otherwise available to the town in consequence of the conduct leading to the criminal penal sanctions. The descriptive language in the second column is for convenience only and does not affect the provisions of the cited Code section.
