§ 6-128. Permits required.

  • (a)

    No person shall attempt relocation of a structure from one site to another without having first obtained a relocation permit from the town. The permit shall be obtained by the owner of the structure or his designated agent. The cost of the permit shall be $50.00. In addition, the owner of the structure, or the licensed contractor responsible for the relocation of the structure to the new site, shall be responsible for obtaining a building permit in accordance with the state uniform building code. No structures shall be moved from Memorial Day through Labor Day. Pre-built existing storage buildings can be transported during the restricted period as long as such move does not obstruct the opposing lane.

    (b)

    Permits shall be valid for 30 days from the date upon which they are issued. If the work required by the provisions of this article has not been completed by the expiration date of the permit, the town shall have the right to cause the removal of the offending structure, materials, and/or debris and charge the cost against the bond as required in section 6-129.

    (c)

    The renewal of permits for one additional 30-day extension may be granted, but within the sole discretion of the town. Such extensions may be allowed only under the following conditions:

    (1)

    Submission of a written request for an extension to the building inspector by the permit holder not later than five days prior to the original permit expiration date.

    (2)

    The permit holder must demonstrate that substantial progress towards the removal of the structure has already been made, and that the permit holder has the means and ability to complete the permitted work within the extension period.

    (3)

    The events which have caused the delay in the removal of the structure have been beyond the control of the permit holder.

    (d)

    The town reserves the right to refuse any application for renewal based upon failure to comply with any of the provisions in subsections (a) through (c) of this section, or as a result of an immediate need to have the structure or debris removed as the result of an impending natural disaster, such as a predicted hurricane, high tide, or similar circumstance.
