§ 6-230. Findings.

  • The town board of commissioners does hereby find, determine and declare that it is in the best interest of the town and its citizens to enact this article in an attempt to reduce the problems created by improperly designed and installed outdoor lighting. It is further the intention of this article to eliminate problems of glare, minimize light trespass, and help reduce the energy and financial cost of outdoor lighting. This article establishes regulations which limit the area that certain kinds of outdoor lighting fixtures can illuminate and limit the total allowable illumination of lots located in the town. The unique geographic circumstances of this community create the requirement for limitations on uncontrolled outdoor lighting. The reduction of excessive artificial lighting on the ocean side of our community tends to enhance the ability of female sea turtles to lay their eggs and for hatchlings to survive. The limitation on artificial lighting on the sound side makes it easier for boaters to see channel navigation lights and markers and thereby creates a safer environment for navigation.
