§ 4-54. Permitting.

  • Horses, mules, donkeys or the riding of a horse or any other similar animal shall only be allowed on the beach strand with a valid permit. For the purpose of this article all animals reasonably similar to a horse, such as a donkey or mule, shall be referred to as a horse. There shall be a charge as in the town fee schedule for a permit to allow a horse access to the beach strand. Permit holders shall be subject to the following regulations:

    (1)

    Permits are only valid for the day they are issued.

    (2)

    Horses shall only be allowed on the beach from 8:30 a.m. to sundown.

    (3)

    Horses shall remain at least 50 feet from the toe of any dune or vegetation line.

    (4)

    The only access point to the beach strand for horses is at Drum Avenue.

    (5)

    The individual or owner responsible for tending to a horse or horses is responsible for cleaning up and removing any solid excrement left by the horse on the beach strand, ground or road.

    (6)

    Each individual riding, walking or tending to a horse must have equipment and containers capable of cleaning up and removing any solid excrement left by the horse on the beach strand, ground or road. As many as six horses may be served by one set of cleaning equipment and containers. Example, if there are six horses in a group, a minimum of one set of cleaning equipment and container is required. If there are seven horses in a group, a minimum of two sets of cleaning equipment and containers are required.

    (7)

    Pedestrians on the road or beach strand have the right-of-way.

    (8)

    Permits may be issued by any police officer, the town manager and the town manager's designees. Permits requested on holidays or weekends may only be issued by a police officer or the town manager.

    (9)

    Any violation of these regulations shall result in the revocation of the permit.

    (10)

    If a permit is revoked or if there is reasonable evidence that a rider or individual was responsible for a violation of these regulations, the town reserves the right to refuse issuance of future permits.

    (11)

    Horses and their owners possessing valid town permits shall only be allowed on the beach strand during the period beginning on October 1 of each year and ending on March 30 of the next year.
