§ 16-320. Action by the board of commissioners.

  • Before taking such lawful action as it may deem advisable, the board of commissioners shall consider the planning board's recommendations on each proposed zoning amendment. If no recommendation is received from the planning board within 65 days after the introduction of the petition at a regularly scheduled meeting, the proposed amendment shall be deemed to have been approved by the planning board. The board of commissioners shall then call for a public hearing, before making a decision. A public hearing shall be held by the town board not more than 60 days before adoption of any proposed amendment to this chapter. Notice of the public hearing shall be made according to the requirements as stated in G.S. 160A-384, as amended, by the North Carolina General Assembly in 1993. Additionally, notice of a proposed zoning change for any parcel, regarding which a petition for change in zoning classification has been filed by any person, shall be prominently posted for at least 15 days prior to the public hearing. The posted notices shall be provided and erected by the zoning administrator/building inspector and shall include in the message the:

    Present zoning classification;

    (2)

    Proposed zoning classification;

    (3)

    Time and place of the public hearing;

    (4)

    Location where additional information may be obtained.
