§ 16-273. Administrative procedures.

  • (a)

    Public hearings. Any case involving a variance, proceedings to revoke any division 3 approval, or appeal from the official's decision requires a public hearing to be held by the board of adjustment and any case involving consideration or modification of a conditional use permit, a change of zoning district classification, or other ordinance changes requires a public hearing to be held by the board of commissioners. Each board shall fix a reasonable time for the hearing and give public notice as required by law as well as due notice to the parties in interest. Each board shall take action on a matter within a reasonable time after the termination of the proceedings.

    (b)

    Revocation of approvals. Revocations of approvals shall be as set forth in divisions 3 and 5 of this article.

    (c)

    Appeals from planning board decisions. Appeals may be taken to the board of commissioners by any person, firm or corporation aggrieved, or by any officer, department or board of the town affected by any decision of the planning board. Such appeals shall be filed with the board of commissioners by notice specifying the grounds for appeal. Appeal shall be filed with the town clerk within 30 days from the date of the planning board action being appealed.

    (d)

    Appeals to board of adjustment to review official decisions. Appeals of division 3 official decisions may be taken to the board of adjustment under section 16-301 and division 5 of this article.

    (e)

    Fees. Each applicant for an appeal from an administrative decision, and division 3 decision, for a variance or conditional use permit, for revocation of an division 3 approval by a party other than the town, or official, or any town board or commission, or with a request for rezoning or other change in this article shall pay a nonrefundable fee to the town to cover the costs of advertising and administration. A schedule of fees shall be approved by the town and may be amended as required. The building inspector shall keep the approved updated fee schedule in his/her office. A receipt of this fee shall be issued by the town. This fee, however, shall not apply to requests originating with any department, board or agency of the town.
