§ 16-512. Specific requirements.

  • (a)

    Multiple-family dwellings. The following standards shall be used in evaluating an application for approval of a conditional use for multiple-family dwellings:

    (1)

    The minimum lot size shall be 10,000 square feet;

    (2)

    Buildings and other improvements shall be so installed that the dune structure shall be maintained;

    (3)

    The maritime forest shall be maintained, except for removal of that which is the absolute minimum to allow reasonable use of the site;

    (4)

    The minimum floor area per dwelling unit shall be as set out in square feet;

    (5)

    There shall be an acceptable plan for the maintenance and preservation of those portions of the site which are left undisturbed; and

    (6)

    The provisions of water supply and sewage disposal systems shall meet the requirements of the town, the county, the state, the United States and any other governmental body having jurisdiction.

    (b)

    Public and private utility stations or substations. The following specific provisions shall be met as minimum standards prior to the approval of any public utility station or substation as a conditional use:

    (1)

    Structure setback minimum from any public or private street: Ten feet.

    (2)

    Rear yard setback minimum: Ten feet.

    (3)

    Side yard setback minimum: Ten feet.

    (4)

    The lot on which the public or private utility station or substation is located shall be landscaped to fit into its surroundings. In the event other uses are permitted on the lot, the landscaping shall be designed taking into consideration the location and use of such other facilities.

    (c)

    Walkways. Walkways are allowed in the C-1, C-2 and C-4 districts as a conditional use subject to the use standards for coastal wetlands, estuarine waters and public trust areas as stated in 15A NCAC 07H.

    (d)

    Club or lodge. Any request for a conditional use permit, in addition to meeting the zoning requirements for its zone, must contain sufficient information to satisfy the town that:

    (1)

    Adequate parking is provided;

    (2)

    Adequate sanitation facilities and capacity is provided;

    (3)

    Adequate screening from other properties is provided; and

    (4)

    Adequate setbacks from property lines are used.
