§ 16-202. Design standards criteria.

  • The design of all streets and roads shall be in accordance with the minimum design and construction criteria for subdivision streets of the state department of transportation. The requirements for residential subdivisions shall be such as the board deems appropriate for the type of development and use contemplated.

    (1)

    Streets. Pavement widths and rights-of-way shall not be less than the following table:

    a.

    Type of facility (local road).

    20-foot pavement

     

    b.

    Grades. Street grades shall not exceed one percent. No street will have a minimum grade of less than 0.5 percent.

    c.

    Tangents. A tangent of at least 100 feet shall be introduced between curves on all streets.

    d.

    Intersections. Street intersections shall be as nearly at right angles as possible and in no cases shall be less than 60 degrees.

    e.

    Cul-de-sacs. Cul-de-sacs shall not be longer than 500 feet and shall be provided with a turnaround having a roadway diameter of at least 90 feet and a right-of-way of at least 100 feet. Temporary turnarounds shall be paved or graveled in accordance with the minimum design and construction criteria for subdivision streets of the state department of transportation and only the right-of-way width shall be dedicated to the town.

    (2)

    Alleys. All alleys shall be constructed in accordance with the minimum design and construction criteria for subdivision streets of the state department of transportation.

    a.

    Right-of-way: 24 feet.

    b.

    Minimum centerline radius when a deflection angle of more than ten degrees occurs: 35 feet.

    c.

    Property line radius at alley intersections: 15 feet.

    d.

    Pavement: 20 feet.

    (3)

    Blocks. Block lengths shall not exceed 1,500 feet nor be less than 400 feet. Where deemed necessary by the planning board a pedestrian crosswalk of at least ten feet in width may be required. Width is to allow for two tiers of lots of minimum depth.

    (4)

    Lots. The requirements of the town zoning ordinance shall govern lot size and standards.

    (5)

    Building setback lines. The requirements of the town zoning ordinance shall govern the location of the minimum building setback lines.

    (6)

    Easements. Utility and other easements shall be provided as follows:

    a.

    Utility easements centered on rear or side lot lines shall be provided where deemed necessary by the planning board, and by the Board of Commissioners, and shall be at least ten feet in width.

    b.

    A crosswalk easement of at least ten feet in width shall be provided if required by the planning board and the Board of Commissioners under subsection (3) of this section.

    (7)

    Access to sound and/or ocean.

    a.

    All cross island street rights-of-way shall extend, full width, to the sound (Banks Channel) and/or ocean mean high-water marks.

    b.

    In subdivision areas being developed, or to be developed in the future, where the approved streets do not provide a ready access to the ocean and/or sound, an access lane area of not less than 20 feet in width shall occur at a maximum of 400-foot intervals to provide public access to the sound and/or ocean; these access lane areas are to be dedicated to the town by the subdivider.

    (8)

    Private streets. All private streets shall meet the following requirements:

    a.

    A private street cannot interconnect two or more public thoroughfares, preexisting or existing public or private streets.

    b.

    The developers shall incorporate a landowners' association, which bylaws shall provide for assessments for the perpetual maintenance of the private street by the property owners served by or adjacent to the private street.

    c.

    The maximum number of lots which, having as their only means of access to a public road by way of a private street, shall not exceed four in number.

    d.

    Road surface width shall not be less than 16 feet in width. The surface must be paved or have a minimum of six inches of rock or marl.

    e.

    If the private street is a dead-end road it must provide at least one vehicle turnaround area. The width of the turnaround area at the point where it adjoins the access easement shall be a minimum of 30 feet. The depth of the turnaround area (measured from the closest edge of the access easement to the back of the turnaround) shall be a minimum of 30 feet. The width of the turnaround area at its furthermost point from the closest edge of the access easement shall be a minimum of 30 feet.

    f.

    Grades. Private street grades shall not exceed one percent. No street will have a minimum grade of less than 0.5 percent.

    g.

    Easements. A formal right-of-way and construction utility easement shall be executed and delivered to the town as follows: Utility easements centered on rear, side, or front lot lines adjacent to the street shall be provided where deemed necessary by the planning board, and approved by the board, and shall be a minimum of ten feet in width, up to a maximum of 15 feet in width.

    h.

    Street names. All private streets must be given a street name. In no case shall the name of the proposed streets duplicate or be phonetically similar to any existing street names, irrespective of the use of the suffix, street, avenue, boulevard, drive, place, court, etc.

    i.

    No private street shall have a curve with a radius of less than 15 feet and shall be designed in a manner so as not to impede reasonable travel thereon of emergency vehicles.
